Die Aufnahme ist aufgrund der sog. Panoramafreiheit nach § 59 UrhG zulässig. Die Vorschrift des § 59 UrhG ist dabei richtlinienkonform anhand des Art. 5 Abs. 3 Buchst. c der Richtlinie 2001/29/EG des Europäischen Parlaments und des Rates vom 22. Mai 2001 zur Harmonisierung bestimmter Aspekte des Urheberrechts und der verwandten Schutzrechte der Informationsgesellschaft („InfoSoc-RL“) auszulegen. Die richtlinienkonforme Auslegung ergibt, dass auch Luftbildaufnahmen von § 59 Abs. 1 UrhG gedeckt sind und auch der Einsatz von Hilfsmitteln nicht aus der Schutzschranke heraus führt.
